OUR TERMS AND CONDITIONS OF ENROLMENT (FULL TIME & PART TIME)

  1. THE CONTRACT
    1. The terms of the enrolment form and these terms and conditions constitute the terms of a legally binding contract (“the Contract”) between you, the student, any invoice addressee set out in the enrolment form and Insight, school of Interior design Limited (“the School”).
    2. Any enrolment application by you will be subject to written acceptance by the School.
    3. The School has the rights to amend the terms and conditions of the contract without prior notice.
  2. THE COURSE
    1. It is a condition of enrolment that you are available to attend during term dates of your course. You may not leave before the end of term or take periods away from the course without prior permission. Any such requests must be agreed by the Course Director.
    2. Insight reserves the right to refuse a student admission to a course if in breach of our academic and personal conduct procedures.
    3. The School reserves the right to change the timing, content, location, professor of any course at any time.
    4. Places on a course are not transferable.
  3. FEES
    1. Enrolment is subject to payment of an enrolment fee as set out in the enrolment form. The enrolment fee will only be repaid if the School is unable to offer you a place on your chosen course or as set out in the Contract.
    2. Following acceptance of your application by the School, you and the invoice addressee will be contractually bound to pay the full amount of the School’s fees (including all instalments) in the manner set out in the enrolment form. No refund will be made if you subsequently do not attend all or any part of the course (and the School is unable to reallocate your place) or if you fail any exam.
    3. If you have elected to pay by instalments and subsequently do not attend, or cease to attend, the course, all outstanding instalments will become immediately payable. If you do not elect to pay by instalments, you and the invoice addressee will be deemed to have elected to pay the full amount of the School’s fees before the start of the course as set out in the enrolment form.
    4. All students are strongly advised to take out insurance against loss of fees due to accident or illness.
    5. Where any fee or part of a fee remains unpaid 14 days after the due date, the School reserves the right to:
      1. charge interest on the overdue amount at the rate of 12% per annum from the due date until actual payment; and/or
      2. suspend you and reallocate your place (without prejudice to the obligation to pay fees); and/or
      3. demand payment in full of all outstanding fees and instalments.
    6. If you/the invoice addressee pay by electronic bank transfer, you/the invoice addressee must ensure that the School receives the full amount due after any bank charges that are payable.
    7. We have the right not to issue a diploma or academic transcript to students on graduation until any outstanding payments on their account have been settled.
  4. LIABILITY
    1. You must not bring any items of special value onto the School’s premises. The School will not accept responsibility for the loss of any personal possessions.
    2. The School will not be liable for any loss suffered by you which is indirect, special or consequential or comprises loss of profits.
    3. The School will not be liable for any loss suffered by you resulting from any event which is beyond the reasonable control of the School.
    4. The School will take the utmost care while marking student’s work, however in the event of any loss or damage to work, the School will be unable to take responsibility.
  5. ACADEMIC AND PERSONAL CONDUCT
    1. For the requested assignments, students must submit work that reflects their level and capacities. Any assignment that is not a result of student’s personal efforts is considered dishonest. Dishonesty includes, but is not limited to cheating (including receiving any unauthorized assistance) and plagiarism (including the unacknowledged use of the work or material of another person or agency).
    2. Students are expected to attend all scheduled classes. Frequent absences or tardiness (more than 20% of the course) may result in failing grade for the course. Students who have not attended any course for 40 days must reapply for readmission.
    3. The School reserves the right to dismiss any student whose conduct is detrimental to the learning environment or the well-being of the other enrolled students.
    4. To earn a residential certificate or a commercial certificate, students are required to be continuously enrolled and must complete all courses and projects required for the certificate, maintaining at least a B grade average in those courses. Current students in residential certificate may pursue a commercial certificate, subject to agreement by the school principal and teaching board.
    5. To earn a diploma, students are required to be continuously enrolled and must complete all courses and projects required for the diploma, maintaining at least a B grade average in those courses. They must also complete an internship of minimum 100 hours.
  6. CANCELLATION (and see additional statutory rights as set out below)
    1. The School reserves the right to cancel a course at any time subject to repayment of any enrolment fee and any fees received in respect of the course or the part of the course that has been cancelled.
    2. You and the invoice addressee have the right to cancel the Contract (and have all monies paid returned by the School) at any time within seven working days after the date of the Contract (the Cancellation Period). This right to cancel must be exercised by notice in writing. If a notice of cancellation is sent by post, it can be posted at any time up to and including the Cancellation Date. If you start attending a course before the Cancellation Date, the right to cancel will be lost.
    3. If you wish to cancel your place on the Diploma course or the Residential and Commercial Certificates course outside the Cancellation Period, you have to give written notice of cancellation to the School not 8 weeks before the start of the Residential or Commercial Certificate, or 12 weeks before the start of the Diploma course (being the first day of the first term), the School will refund any fees paid, less the enrolment fee/ deposit. If the written notice of cancellation is given less than 8 weeks before the start of the Residential or Commercial Certificate, or 12 weeks before the start of the Diploma course, you will not be entitled to any refund of the fees and, if you have not paid the balance of the fees, you must do so, unless a replacement student can be found.
    4. In the case of either a Student being unable to obtain a Visa to study in Hong Kong, Insight will transfer the full enrolment fee / deposit to a future start date of the same course or refund the enrolment fee / deposit less a HK$7000 administration charge, as long as the student contacts the School at least 15 working days prior to the start date of the course. Insight must receive written proof of the Visa being declined and this must be sent to Insight within 5 working days of receipt of that letter.
    5. If a written request is provided 4 weeks before the start date of a course you are enrolled on, the School will allow a transfer to a future start date of the same course. Transfers will not otherwise be allowed.
    6. You may also cancel the contract: if an event outside our control prevent us from providing the teaching services when we are supposed to for two weeks or more, or if we go into liquidation.
    7. If you are dismissed from the School as a result of disciplinary action, you are responsible for all tuition fees.
    8. If you are academically dismissed from the School, all payments for tuition for a subsequent term are refunded.
  7. GENERAL
    1. You agree to keep confidential all course materials supplied to you by the School. Copyright and all other intellectual property rights in all course materials belong to the School.
    2. The School will not provide any personal information about any student, including details of academic progress, to a 3rd Party unless the Student makes a specific request for information to be released to a given 3rd Party and this is then agreed by the Principal or Director of Studies.
    3. You agree to grant to the School in respect of any work produced by you during the course, a perpetual royalty-free licence to copy and display such work for promotional purposes only.
    4. The Contract contains all of the contractual terms agreed between you, the invoice addressee and the School.
    5. No failure or delay by the School in enforcing any of its rights under the Contract shall be deemed to be a waiver of such right.
    6. The Contract shall be governed by Hong Kong law.
  8. SPECIAL WEATHER ARRANGEMENT
    1. The School will be closed if Typhoon Signal No.8 (or above) or Black Rainstorm Warning is hoisted. For make-up class, please contact [email protected] for information.
  9. DESIGN TRIP
    1. The physical person or corporate body who buys a cultural excursion from the School is hereafter referred to as “the buyer” and will be considered the beneficiary of the bought service. 
    2. The general terms of sale described below define the rights and obligations of the School and of its customers within the framework of the sale of cultural excursions. Any order thus implies the unconditional, complete and irrevocable agreement of the buyer to the general terms of sale. An “order” is a booking requested by the buyer for which availability has been confirmed by the School. These terms apply regardless of any other terms of sale in any country.
    3. The School reserves the right to adapt or modify the general terms of sale anytime and without notice. The applicable terms are those in effect at the time of the order.
    4. The prices of the services are the prices quoted at the time of the order. They are stated in Hong Kong Dollars (HKD). The price of the services includes the services of a guide, the tickets for entering the places mentioned in the description (museums, monuments, etc.), daytime transportation from place to place and booking expenses. The price does not include flight to and from Paris.
      All prices on the website are stated in Hong Kong Dollars (HKD). Prices are contractual rates. The price of the cultural excursion is not negotiable from the moment the booking request is made.
      Unless otherwise specified, all excursions will start within Paris intra-muros, at the location indicated by the buyer. The schedule is strictly programmed, and the start time will be rigorously respected. It is advised to be ready to leave 15 minutes before the start of the chosen excursion. To make sure the excursion goes smoothly, the schedule indicated by the guide shall be respected. The return time indicated on the schedule is based on normal traffic conditions. The School will not be held responsible for any possible delays.
      The School reserves the right to adjust its prices anytime. Nevertheless, services will be invoiced at the rate indicated at the time of the order.
      The School reserves the right to adjust its program, and the choice of its service providers without notice for practical and technical reasons. For the same reasons, the order of the various places visited can be modified without notice.
    5. The School reserves the right to grant to the buyer discounts compared to the indicated price. No reduction will be granted once payment is due.
    6. The reservation is registered upon reception of the “Reservation commitment” duly completed and signed, accompanied by the payment (via PayPal, bank transfer, or by cheque) corresponding to the price of the cultural excursion.
      The reservation process of a cultural excursion takes place as follows:
      On the website: the buyer fills out a booking request form and process payment by PayPal or bank transfer. The school contacts the buyer within 48 hours (two working days) for confirmation.
      By telephone: The School will send the buyer an invoice with the registration form once the information is communicated. A confirmation of reservation will be sent to the buyer via email once the payment is confirmed.
    7. The orders are paid as follows:
      by PayPal;
      by bank transfer;
      or by cheque.
      The buyer formally commits to pay the amount of the agreed upon service by any of the aforementioned means before the date of the excursion. Payments on the website are made through a secure payment process. Payment shall be cashed within the 24 hours (one working day) following the date payable.
      The following is not considered as in full discharge of the debt: the use of a payment card number in the case that the authorization is not obtained from the payment authority. If payment is not made in full, the School has the right to consider that the buyer has cancelled the reservation.
    8. In the case of cancellation by the buyer less than 14 (fourteen) days before the start of the trip, the amount due must be paid in full. Any cancellation by the buyer between 30 (thirty) and 15 (fifteen) days preceding the date of the trip will require payment of 75% of the amount due. In the case of cancellation by the buyer between the date of booking and 30 (thirty) days before the excursion, only the 400 Hong Kong Dollars (HKD) all inclusive application fee will be charged.
      Given the service requirements of the School, it is impossible to postpone the trip, which has already been booked. If the School is forced to cancel a reservation, the buyer is immediately informed by email and the full amount paid by the buyer is refunded within 7 (seven) days. 
      The School reserves the right to modify its cancellation policy on a case-by-case basis.
    9. The risks involved during transportation of the customers are entirely covered by the insurance of the car and driver company.
    10. In a case of force majeure the School shall in no way be responsible for the non-execution or for the delay in the execution of any of its obligations described in the general terms of sale.
      A case of force majeure implies any external event, unpredictable and irresistible as mentioned in the article 1148 of the French Civil code and including in particular cases of transportation interruptions, strikes, extreme weather conditions, or fire.
      All reservations are registered solely on the basis of the information given by the buyer or by the designated intermediary. The buyer is required to verify the details of the order.
      The School declines all responsibility in the case of a reservation made on the basis of incomplete or inaccurate information.
      The School reserves the right to implement penalties in the case that the customer does not respect: the general terms of sale, the visiting regulations of the places visited, the regulations of the companies providing the driver and car in which the group will be transported, as well as the rules of conduct enforced in any place that is part of the trip.
      The buyer is strongly advised to take out insurance against loss of fees due to accident or illness that the School shall in no way be responsible for.
    11. Unless otherwise specified by the buyer, the School reserves the right to use images of and quotes by the buyer in promotional and other relevant materials.
      It is the buyer’s responsibility to ensure that the contact information provided upon reservation is accurate and will allow him to receive confirmation of his booking. In the case that the buyer does not receive confirmation, he must contact the School. The school can in no case be held responsible if the buyer does not receive confirmation of his order due to a mistake made by the buyer while entering his data.
    12. If for any reason, one of the aforementioned terms of sale must be declared inapplicable, this does not affect the applicability of other terms, and the inapplicable term shall be replaced by another term as close to the original as possible.
